1. Who we are

These terms apply to your use of the Polaris Innovations LLC website, the scorecard and scoping tools, and the pages and emails that link to them (the “Site”). By using the Site you agree to these terms. If you do not agree, please do not use it.

2. What the Site provides

The Site describes our services and offers free tools, such as the scorecard and the scoping assessment, that give you estimates and suggestions about your business processes.

The results are general information. They rely on the answers you give and on assumptions, for example about how much time a team spends on a task, so they are estimates and not guarantees of savings, revenue or results.

3. Your information

When you use a tool or contact us, please give accurate information and only information you are allowed to share. Do not enter sensitive personal data such as payment card or government ID numbers.

How we handle what you submit is described in our Privacy Policy.

4. Acceptable use

You agree not to misuse the Site. That includes trying to break or overload it, probing it for vulnerabilities without our written permission, scraping it at scale, submitting false or unlawful content, or using it to send spam.

5. Emails and opting out

We may email businesses about our services. Every such email identifies us, includes our postal address and contains an unsubscribe link. If you opt out, we stop emailing you and keep your address on a suppression list so that we do not contact you again.

6. Paid services

Paid work is covered by a separate written agreement or proposal that sets out the scope, price and timing. If that agreement conflicts with these terms, the agreement controls for that work.

7. Intellectual property

The Site, its text, design and software belong to Polaris Innovations LLC or its licensors. You may view and use the Site for your own business purposes, but you may not copy, resell or build a competing service from it without our permission. Reports and results the tools generate for you are yours to use internally.

8. No warranty

The Site and tools are provided “as is” and “as available.” We do not promise that they will be uninterrupted, error-free or fit for a particular purpose, to the fullest extent the law allows.

9. Limitation of liability

To the fullest extent the law allows, Polaris Innovations LLC is not liable for indirect, incidental or consequential damages, or for lost profits or data, arising from your use of the Site or its tools. For free tools and the Site, our total liability is limited to $100.

10. Changes

We may update these terms or the Site from time to time. The “Last updated” date above shows the latest version. Continuing to use the Site after a change means you accept it.

11. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Courts located in Virginia have jurisdiction over any dispute, unless the law requires otherwise.
